Terms of Service

Please read these terms carefully. They govern your use of the AwayStay platform and all services within it.

These Terms of Service (“Terms”) constitute a legally binding agreement between you and AwayStay, Inc. By creating an account or using any AwayStay service, you agree to these Terms. If you do not agree, do not use our services.

1. About AwayStay

AwayStay, Inc. (“AwayStay,” “we,” “us,” or “our”) operates an online marketplace and mobile application that connects guests with hosts offering short-term accommodations, provides ride-hailing services through ez-Ride, and provides food delivery services through ez-Eats.

AwayStay is a platform. For stays, we are not the host and we are not a party to the rental agreement between guest and host. For ez-Ride, drivers are independent contractors, not employees of AwayStay. For ez-Eats, restaurants are independent businesses, and delivery drivers are independent contractors.

2. Eligibility and Account Registration

You must be at least 18 years old to create an account or use AwayStay services. By creating an account, you represent and warrant that you meet this requirement.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@awaystay.fun if you suspect unauthorized account access.

You may not create more than one personal account. You may not create an account on behalf of another person without their express consent.

3. Stays — Guest Terms

Bookings and payment

When you book a property, you agree to pay the total amount shown at checkout, which includes the nightly rate, any cleaning fee set by the host, and a non-refundable guest service fee of 7% of the subtotal. Payment is processed at the time of booking. Funds are held and not released to the host until check-in.

Cancellation and refunds

Refund eligibility depends on the host’s cancellation policy, which is displayed on every listing before booking:

Guest conduct

You agree to treat host properties with care, comply with any house rules set by the host, and vacate the property by the agreed checkout time. You are liable for any damage you cause to a property beyond normal wear and tear.

4. Stays — Host Terms

Listing your property

By listing a property on AwayStay, you represent that you have the legal right to rent the property and that your listing complies with all applicable local laws, zoning regulations, and any homeowner association rules. You are solely responsible for ensuring you have all required permits and licenses.

Host fees and payouts

AwayStay charges hosts a platform fee of 13% per booking. Your payout is the booking subtotal minus this 13% fee. Payouts are initiated within 24 hours of a guest’s confirmed check-in. To receive payouts you must connect a Stripe Express account through the Host Dashboard.

Host responsibilities

Hosts are responsible for the accuracy of their listing, maintaining the property in the condition shown, honoring confirmed bookings, and responding to guest communications in a timely manner. AwayStay reserves the right to suspend or remove listings that generate repeated complaints or violate these Terms.

5. ez-Ride Terms

ez-Ride connects riders with independent contractor drivers. AwayStay does not employ drivers; drivers set their own schedules and use their own vehicles.

Fares are estimated before a ride is confirmed. Final fares may vary based on actual route, traffic, and applicable surge pricing during high-demand periods. The fare breakdown, including any surge multiplier, is displayed before you confirm a ride.

Riders with Silver loyalty status (5+ qualifying stays) receive a 10% discount on ez-Ride fares while they have an active AwayStay booking. Riders with Gold loyalty status (10+ qualifying stays) receive a 15% discount while they have an active AwayStay booking. ez-Eats Plus subscribers receive an additional 5% stacked discount, up to a combined maximum of 20%.

You agree not to request rides for illegal purposes, to treat drivers with respect, and not to leave the vehicle in an unsafe state. Drivers may cancel rides and report misconduct. Repeated reports may result in account suspension.

6. ez-Eats Terms

ez-Eats connects customers with local restaurants and independent delivery drivers. AwayStay is not responsible for the quality, preparation, or accuracy of food orders; those responsibilities rest with the restaurant.

A distance-based delivery fee applies to each order. The fee is calculated based on the distance between the restaurant and your delivery address, subject to a minimum of $2.49 and a maximum of $11.99 per order. Demand surcharges may apply during peak meal hours. The exact delivery fee is displayed at checkout before you confirm an order. Delivery is free on orders of $35 or more (or $25 or more for ez-Eats Plus subscribers). A customer service fee of 7% of the order subtotal also applies and is displayed at checkout.

Refunds for incorrect or missing items are handled through our support team. Contact support@awaystay.fun within 48 hours of delivery for refund consideration.

ez-Eats Plus is a $6.99/month subscription that provides reduced free-delivery thresholds and additional discounts. Subscriptions renew automatically until cancelled. You may cancel at any time; benefits continue through the end of your paid period.

7. Loyalty Program

AwayStay rewards frequent guests with tiered ride discounts based on the number of confirmed stays of three or more nights completed on the platform.

Discounts are applied automatically to ride estimates. Both tiers require an active AwayStay booking to apply — discounts reward active travelers. Both tiers are stackable with ez-Eats Plus (+5%) up to a combined maximum of 20%. Loyalty status is non-transferable.

8. Referral Program

AwayStay offers a referral program for ez-Ride riders. When you share your unique referral code with a friend and they create an account, their account will be linked to your referral. Once your referred friend completes their third ez-Ride trip, you will automatically receive two $5.00 ride credits, each applied as a flat discount on your next two ez-Ride bookings.

There is no cap on the number of referrals you may make. Ride credits do not expire, are non-transferable, and have no cash value. Credits are applied after any loyalty or ez-Eats Plus discounts and will not reduce a fare below $1.00. AwayStay reserves the right to modify, suspend, or terminate the referral program at any time and to void credits obtained through fraudulent or abusive activity.

9. Prohibited Conduct

You agree not to:

Violation of these prohibitions may result in immediate account suspension, removal of listings, forfeiture of pending payouts, and legal action where appropriate.

10. Intellectual Property

The AwayStay name, logo, and all content on the platform (except user-submitted content) are the property of AwayStay, Inc. You may not use our trademarks, logos, or proprietary content without prior written permission.

By submitting content to AwayStay (such as listing photos, reviews, or profile images), you grant AwayStay a non-exclusive, royalty-free, worldwide license to display and use that content in connection with operating and promoting the platform.

11. Disclaimers and Limitation of Liability

AwayStay provides its platform “as is” without warranties of any kind, express or implied. We do not guarantee the accuracy of listings, the conduct of hosts, guests, or drivers, or the uninterrupted availability of our services.

To the maximum extent permitted by applicable law, AwayStay’s total liability to you for any claim arising from use of our services shall not exceed the greater of (a) the amount you paid to AwayStay in the 12 months preceding the claim, or (b) $100 USD.

AwayStay is not liable for indirect, incidental, special, or consequential damages, including lost profits, loss of data, or personal injury not directly caused by our own negligence.

12. Dispute Resolution

In the event of a dispute between a guest and host, AwayStay may, at its discretion, assist with mediation but is not obligated to resolve disputes or provide refunds beyond what is required by these Terms.

Any dispute between you and AwayStay shall be resolved by binding arbitration under the rules of the American Arbitration Association, except that either party may bring claims in small claims court for disputes within that court’s jurisdiction. You waive the right to a jury trial and the right to participate in a class action.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting a notice in the app or sending an email at least 14 days before the change takes effect. Continued use of AwayStay after the effective date constitutes acceptance of the updated Terms.
